TERMS & CONDITIONS

Welcome to Soda Hunt.

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “user,” “Hunter,” “Business,” or “Participant”) and SPG Web + Marketing LLC d/b/a Soda Hunt (“Soda Hunt,” “we,” “our,” or “us”) regarding your use of the Soda Hunt website, web app, QR code experiences, campaigns, promotions, sweepstakes, business listings, and related services (collectively, the “Platform”).

By accessing, browsing, registering for, participating in, or using the Platform in any way, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you must discontinue use of the Platform immediately.

1. ABOUT SODA HUNT

Soda Hunt is an independent promotional and engagement platform designed to encourage exploration of participating businesses through QR code interactions, promotional offers, giveaways, contests, and interactive campaigns.

Soda Hunt currently operates primarily as a web-based experience and may later expand into mobile applications, push notifications, and additional technologies.

Soda Hunt is an evolving platform. Features, functionality, promotions, participation methods, campaign structures, branding, mechanics, and experiences may change, evolve, improve, or be modified at any time without prior notice.

2. NO AFFILIATION WITH FIFA OR WORLD CUP ENTITIES

Soda Hunt is an independent promotional platform and is not affiliated with, endorsed by, sponsored by, or officially connected to FIFA, the FIFA World Cup, or any related governing entities, organizations, sponsors, or affiliates.

Any references to soccer events, tournaments, or Kansas City visitor experiences are purely descriptive and do not imply official affiliation.

3. ELIGIBILITY

The Platform is intended for users who are at least 13 years old.

Users must be at least 21 years old to be eligible for prize drawings, cash giveaways, or certain promotional opportunities unless otherwise permitted by law.

By using the Platform, you represent and warrant that:

  • all information submitted is accurate and truthful;
  • you have the legal capacity to enter into these Terms;
  • you are not prohibited from participating under applicable law; and
  • your use of the Platform complies with all applicable local, state, and federal laws.

4. NO PURCHASE NECESSARY

NO PURCHASE IS NECESSARY TO PARTICIPATE IN SODA HUNT OR TO BE ENTERED INTO RANDOM PRIZE DRAWINGS.

Participation in Soda Hunt is free for Hunters.

Participation, QR scans, business visits, purchases, social engagement, or interactions with participating businesses do not guarantee prizes, winnings, rewards, discounts, compensation, or promotional benefits.

All prize opportunities are subject to availability, eligibility, and random selection methods determined solely by Soda Hunt.

5. RANDOM PRIZE DRAWINGS

Soda Hunt may conduct random prize drawings, cash giveaways, contests, sweepstakes, or promotional campaigns.

All winners are selected randomly unless otherwise specified.

Odds of winning depend on participation levels, eligibility, campaign duration, and other variables.

Soda Hunt reserves the right to:

  • modify prize structures;
  • substitute prizes;
  • delay prize distribution;
  • suspend or cancel prize opportunities;
  • verify participant eligibility;
  • investigate suspicious activity;
  • withhold prizes in cases of suspected fraud;
  • or terminate promotions at any time.

Participants are solely responsible for any taxes, fees, reporting obligations, or liabilities associated with prizes.

6. PARTICIPATING BUSINESSES

Soda Hunt serves as a promotional platform connecting Hunters with independently owned participating businesses.

Participating businesses are solely responsible for:

  • honoring their submitted promotional offers;
  • maintaining product and service availability;
  • staffing and operations;
  • customer interactions;
  • pricing;
  • inventory;
  • food safety;
  • legal compliance; and
  • overall customer experience.

Businesses may modify, suspend, limit, or discontinue offers at any time.

Businesses are encouraged to provide Soda Hunt with at least 48 hours written notice for changes whenever reasonably possible.

Soda Hunt does not guarantee:

  • availability of offers;
  • product inventory;
  • staffing availability;
  • customer satisfaction;
  • business participation continuity;
  • quality of services;
  • or redemption success.

Soda Hunt is not liable for disputes between Hunters and participating businesses.

7. BUSINESS PARTICIPATION DISCLAIMERS

Businesses participating in Soda Hunt acknowledge and agree that:

  • participation fees are campaign-based;
  • participation fees are non-refundable except where Soda Hunt cancels a campaign entirely;
  • Soda Hunt does not guarantee foot traffic;
  • Soda Hunt does not guarantee sales or revenue;
  • Soda Hunt does not guarantee social media exposure;
  • Soda Hunt does not guarantee press coverage;
  • Soda Hunt does not guarantee newsletter placement;
  • Soda Hunt does not guarantee media mentions;
  • Soda Hunt does not guarantee campaign performance;
  • Soda Hunt does not guarantee customer conversions;
  • Soda Hunt does not guarantee specific visitor counts;
  • Soda Hunt does not guarantee profitability or return on investment.

Businesses understand that Soda Hunt is an evolving campaign platform and that campaign mechanics, promotional methods, visibility, and engagement strategies may evolve throughout campaign periods.

8. USER CONDUCT

Users agree not to:

  • submit false information;
  • manipulate QR scans;
  • create fake accounts;
  • exploit technical systems;
  • impersonate other users;
  • interfere with Platform functionality;
  • harass businesses or participants;
  • use bots, scripts, or automated systems;
  • engage in fraudulent participation;
  • attempt to gain unfair promotional advantages;
  • upload malicious software;
  • or violate applicable laws.

Soda Hunt reserves the right to suspend, restrict, remove, or permanently ban users or businesses for suspected misconduct, abuse, fraud, or violations of these Terms.

9. SMS, EMAIL & COMMUNICATION CONSENT

By voluntarily providing your phone number and/or email address, you expressly consent to receive:

  • promotional emails;
  • newsletters;
  • campaign announcements;
  • marketing messages;
  • reminders;
  • business offers;
  • SMS communications;
  • push notifications;
  • app notifications;
  • and other communications from Soda Hunt and participating businesses.

Message frequency may vary.

Message and data rates may apply.

Consent is not a condition of purchase.

Users may opt out at any time by:

  • clicking unsubscribe links;
  • replying STOP to SMS messages;
  • or contacting Soda Hunt directly.

Users acknowledge that future campaigns may involve expanded communication systems including app notifications and mobile experiences.

10. PRIVACY & DATA SHARING

By using the Platform, users acknowledge and agree that Soda Hunt may collect:

  • names;
  • email addresses;
  • phone numbers;
  • browser information;
  • IP addresses;
  • QR engagement activity;
  • location check-in activity;
  • campaign participation information;
  • device information;
  • analytics;
  • and other voluntarily submitted data.

Users acknowledge and agree that participation data, registration information, engagement analytics, and contact information may be shared with participating businesses, sponsors, partners, and affiliated promotional entities after campaigns for marketing, analytics, customer engagement, and follow-up communications.

Soda Hunt does not sell personal information in the traditional third-party data broker sense; however, information may be shared with participating businesses and campaign partners as part of the Soda Hunt experience.

Use of the Platform constitutes consent to these practices.

11. MEDIA RELEASE

By participating in Soda Hunt, users grant Soda Hunt and its affiliates permission to use photographs, videos, social media content, usernames, testimonials, reviews, likenesses, voices, and related content for promotional, advertising, editorial, and marketing purposes without additional compensation unless prohibited by law.

12. PLATFORM AVAILABILITY

Soda Hunt does not guarantee uninterrupted Platform availability.

The Platform may experience:

  • outages;
  • maintenance interruptions;
  • QR scanning issues;
  • technical delays;
  • software errors;
  • browser incompatibilities;
  • internet disruptions;
  • third-party system failures;
  • or other interruptions.

Soda Hunt shall not be liable for any losses, inconveniences, or damages arising from technical interruptions.

13. FORCE MAJEURE

Soda Hunt shall not be liable for delays, interruptions, modifications, failures, or cancellations caused by events beyond its reasonable control, including but not limited to:

  • acts of God;
  • severe weather;
  • government actions;
  • labor shortages;
  • internet failures;
  • server outages;
  • vendor failures;
  • travel disruptions;
  • public emergencies;
  • infrastructure failures;
  • or large-scale event disruptions.

14. INTELLECTUAL PROPERTY

All Soda Hunt branding, logos, QR systems, promotional structures, marketing materials, graphics, concepts, content, trademarks, and intellectual property are owned by or licensed to SPG Web + Marketing LLC d/b/a Soda Hunt.

No content may be copied, reproduced, republished, distributed, or commercially exploited without prior written consent.

15. DISCLAIMER

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, SODA HUNT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.

PARTICIPATION IN SODA HUNT IS AT YOUR OWN RISK.

SODA HUNT SHALL NOT BE RESPONSIBLE FOR:

  • business disputes;
  • expired offers;
  • denied offers;
  • inventory shortages;
  • food safety issues;
  • injuries;
  • technical failures;
  • lost data;
  • travel expenses;
  • transportation issues;
  • delayed prizes;
  • or user dissatisfaction.

16. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, SPG WEB + MARKETING LLC D/B/A SODA HUNT, INCLUDING ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, REPRESENTATIVES, AND AGENTS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE PLATFORM.

THIS INCLUDES BUT IS NOT LIMITED TO:

  • LOST PROFITS;
  • BUSINESS LOSSES;
  • LOST DATA;
  • LOST OPPORTUNITIES;
  • PERSONAL INJURIES;
  • PROPERTY DAMAGE;
  • PRIZE DISPUTES;
  • OR CAMPAIGN-RELATED CLAIMS.

17. TERMINATION

Soda Hunt reserves the right to terminate, suspend, restrict, or deny access to any user or business at its sole discretion without notice.

18. GOVERNING LAW

These Terms shall be governed by the laws of the State of Missouri.

Any disputes arising under these Terms shall be resolved exclusively within the State of Missouri.

19. CHANGES TO TERMS

Soda Hunt reserves the right to modify these Terms at any time.

Updated versions become effective immediately upon posting.

Continued use of the Platform constitutes acceptance of revised Terms.
